2. Eligibility
You must be at least 18 years old, have legal capacity, and use Qually for business purposes.
3. User Responsibilities
You agree to:
- Keep account credentials secure
- Use Qually in compliance with all applicable laws
- Obtain all legally required call participant consent before recording or transcribing calls
- Not misuse, modify, reverse engineer, scrape, or overload the service
You are responsible for all content you send, upload, or process using Qually.
You also agree not to submit or process sensitive personal data unless legally permitted and necessary for your use case.
4. Service Description
Qually provides:
- Real-time sales call insights
- Objection handling
- AI-generated notes & summaries
- Coaching prompts
- Document-powered insights
- CRM enrichment
- Integrations with supported tools
- A cloud-hosted web application
We may update, improve, or modify the service at any time.
Qually uses analytics tools—including Firebase Analytics—to understand product usage, diagnose performance issues, and improve service reliability.
5. Subscriptions & Billing
- Plans are billed through Stripe
- Monthly and annual options are available
- Per-seat pricing applies
- A 7-day free trial is available
You authorize Qually to charge your chosen payment method for subscription fees.
Taxes may apply depending on your location.
6. Cancellation & Refunds
- You may cancel at any time during the 7-day free trial at no cost
- After the trial ends, subscription fees are non-refundable, except where required by law
- If you cancel, your subscription continues until the end of the current billing period
To avoid charges, cancel before your trial ends.
7. Intellectual Property
Qually retains all rights, title, and interest in the platform, models, features, software, and content.
You retain ownership of:
- Your data
- Your uploaded documents
- Any materials or content you provide
You grant Qually a limited license to process this content solely for the purpose of providing and improving the service.
8. Third-Party Services
Qually relies on third-party vendors for hosting, AI model inference, analytics, payments, and speech-to-text processing.
These include but are not limited to:
- OpenAI, Google Gemini, Groq (AI processing)
- Deepgram (speech-to-text)
- Supabase, Railway, Vercel, GCP (infrastructure)
- Statsig, Laminar, Firebase Analytics, Posthog (analytics & logging)
- Stripe (payments)
Your use of Qually constitutes agreement to the terms of these providers where applicable.
9. Termination
We may suspend or terminate your access to Qually if:
- You violate these Terms
- You misuse or abuse the platform
- You engage in unauthorized, harmful, or unlawful activities
- We determine suspension is necessary for security or system integrity
You may delete your account at any time. Account deletion triggers our data deletion process as described in the Privacy Policy.
10. Limitation of Liability
To the fullest extent permitted by law:
- Qually is not liable for indirect, incidental, consequential, or punitive damages
- Qually's total liability for claims arising from these Terms will not exceed the amount you paid in the 12 months preceding the event giving rise to the claim
Qually is provided on an “as is” and “as available” basis.
11. Governing Law
These Terms are governed by the laws of Ireland, without regard to conflict of law principles.
Any disputes will be resolved exclusively in the courts of Ireland.
12. Updates to These Terms
We may modify these Terms from time to time.
If changes are material, we will notify you by email or through the platform.
Continued use of Qually after updates become effective constitutes acceptance of the revised Terms.
